The state does not have complete and unified information about its reclamation systems because of the lack of an effective management system.
It is not clearly defined what institutions own such systems, whether there are title documents on them and whether the relevant ownership right to certain infrastructure elements has been registered in the State Register of Proprietary Rights to Real Estate and Their Encumbrances. There is also no complete and unified information on the number of national, inter-farm and intra-farm reclamation systems.
Experts from the Agriculture Sector of the Better Regulation Delivery Office (BRDO) conducted a study on the irrigation and drainage system. They also developed a three-level organisational and economic model of reforming the management of reclamation systems in Ukraine. This model covers all possible ways to reform the functioning of reclamation systems provided for by the legislation of Ukraine.
The priority steps include:
- Conducting a complete inventory of the existing engineering reclamation infrastructure and entering inventory data into the Public Cadastral Map of Ukraine and the State Water Cadastre. Creating a geospatial data infrastructure.
- Approving the list of national reclamation systems by the Government.
- Creating a single publicly available electronic database for irrigated and drained land monitoring.
- Determining/changing the ownership right (state, communal, private) and creating the possibility for registering the ownership right to the reclamation system as a real estate object.
- Ensuring continuous monitoring of irrigation and drainage systems.
BRDO experts propose to develop a separate draft law “On Specifics of Management of State-Owned Objects in the Sphere of Reclamation Systems” and establish a separate state enterprise with special legal conditions.
This step will allow to restore the integrity of irrigation and drainage systems, stop the reduction of irrigation areas, and simplify/improve the procedures for construction/reconstruction of new systems. This draft law will help the state obtain opportunities to attract investments and flexibility in management.
