UAH 100 mln of annual budget savings: Parliament adopted the law on national geospatial data infrastructure

On April 13, Ukrainian Parliament approved the draft law No.2370 “On National Infrastructure of Geospatial Data” in the second reading. The Construction Sector experts from the Better Regulation Delivery Office participated in the drafting of this law. 

The draft law defines in what way the national geospatial data infrastructure is created, filled, and developed, as well as the possibility of barrier-free access to geospatial data for all individuals and legal entities.

The law drafters emphasize that the introduction of a unified portal with free access to geospatial data of all cadastres and registers makes it possible for the state budget to save annually UAH 100 million currently lost due to inconsistencies between different administrators of cadastres and registers.

According to the adopted law, geospatial data created by different entities include, in particular, data on boundaries and coordinates of administrative-territorial units, territorial communities and boundaries and coordinates of their territories, settlements, buildings, roads, railways, land plots, data on underground utility systems and utility supply lines, etc.

Currently, geospatial data are generated by various government authorities and local government bodies, as well as by other economic entities in accordance with different technical requirements. However, there are both the duplication of efforts in creating geospatial data by different government authorities, local government bodies or economic entities and unnecessary expenses, while the access to the created data is often restricted due to monopoly. The adopted law is aimed to establish the legal framework and principles of functioning of the national geospatial data infrastructure. The access of users to geospatial data and metadata will be ensured through the national geoportal – an official website of the national geospatial data infrastructure managed by the State Service for Geodesy, Cartography and Cadastre.

Among other aspects, the law on national infrastructure of geospatial data is necessary for the full and transparent launch of the land market scheduled for July 1, 2021.

With the introduction of the law, the Cabinet of Ministers is tasked with developing and implementing a Procedure of the functioning of the national geospatial data infrastructure. In particular, government officials should determine which executive authorities, local government bodies and other holders will be responsible for creating and updating geospatial data and metadata.
