Project objective​

The enhancement of the efficiency of state regulatory oversight measures and the improvement of their transparency for businesses can be achieved by means of improving the protocols of state regulatory oversight through the introduction of amendments to Law No. 877 of Ukraine, which pertains to the fundamental principles of state regulatory oversight in the field of economic activity. The aforementioned modifications are to be implemented in the integrated automated system of state regulatory oversight.

Key project stages​

Improvement of the existing system of state supervision (control) through the following measures:

• Introduction of amendments to the Law of Ukraine No. 877 “On the basic principles of state supervision (control) in the field of economic activity” to optimize the planning and implementation of state supervision (control) measures;
• Introduction of amendments to the regulatory framework to enable authorities to receive and review complaints through the integrated system of state supervision and control;
• Update of the Inspection Portal to implement the aforementioned changes;
• Introduction of amendments to the regulatory framework to enable state supervision (control) authorities to conduct certain inspection procedures remotely, as well as to document and publish the results of such procedures online through the integrated automated system of state supervision (control).

2. Completion of the first stage of the implementation of the risk-based approach to performing state supervision (control) functions through:

• Legal processing of new unified forms of inspection reports to ensure their compliance with the “Methodology for the development of unified forms of inspection reports resulting from planned (unplanned) state supervision (control) measures”, approved by Resolution of the Cabinet of Ministers of Ukraine dated May 10, 2018, No. 342.

Project description

As a result of the legal part of the project, the following has been developed:

• Draft Law of Ukraine “On the Basic Principles of State Supervision (Control)” – jointly with the Ministry of Economic Development, Trade and Agriculture of Ukraine with the participation of the State Regulatory Service of Ukraine (hereinafter – the Draft Law);
• Analytical note on challenging the actions or inactivity of employees and decisions of state supervision (control) authorities by business entities;
• Analytical note on conducting state supervision (control) measures over the economic activities of business entities in electronic form (using electronic document exchange) by state supervision (control) authorities;
• Draft amendments to the Procedure for the functioning of the Integrated Automated System of State Supervision (Control), inclusion of information in it, and terms of publication of this information, approved by the Resolution of the Cabinet of Ministers of Ukraine No.388 of May 24, 2017.

Description of results:

1. Draft Law of Ukraine “On Basic Principles of State Supervision (Control)”

Developed jointly with the Ministry of Economic Development, Trade and Agriculture of Ukraine with the participation of the State Regulatory Service of Ukraine.

The main objectives of the state regulation of the new project are:

• Ensuring a favorable environment for business activities;
• Creating proper conditions for the development of small and medium-sized enterprises (increasing the number of business entities by 2%);
• Improving the legal regulation of state supervision (control) in the field of economic activity;
• Establishing a unified approach to the implementation of measures of state supervision (control);
• Eliminating ineffective and burdensome norms of state control.

2. Draft amendments to the Procedure for the functioning of the integrated automated system of state supervision (control), inclusion of information therein and terms of publication of this information, approved by the resolution of the Cabinet of Ministers of Ukraine No. 388 of May 24, 2017

The implementation of certain provisions of the draft Law is possible only in the presence of corresponding provisions in the Procedure for the functioning of the integrated automated system of state supervision (control), inclusion of information therein and terms of publication of this information.

In particular, the provisions concerning online appeal by business entities of actions or inaction of employees and decisions of state supervision (control) authorities and the implementation by state supervision (control) authorities of measures of state supervision (control) over the economic activity of business entities in electronic form (through the exchange of electronic documents).

To prepare the aforementioned amendments, analytical work was carried out, reflected in the draft resolution of the Cabinet of Ministers of Ukraine “On Amendments to the Procedure for the functioning of the integrated automated system of state supervision (control), inclusion of information therein and terms of publication of this information…”.

As a result of the technical part of the project, the following was developed:

• Technical specifications for additional functionality
• Additional functionality for the Integrated Automated State Supervision (Control) System in accordance with the innovations planned by the Law project.
