President’s veto on the Law “On Electronic Communications”: BRDO submitted proposals to the Parliament for revision

The President of Ukraine vetoed the European integration law “On Electronic Communications”, adopted by the Verkhovna Rada on September 30. The document was sent for revision.

BRDO experts analyzed the President’s comments on the Law “On Electronic Communications” (they have actively participated in its drafting) and submitted proposals and comments to the Parliament for consideration. The full text of the proposed changes is available here.

We are convinced that the revision of the law will allow to correct technical inaccuracies, such as the inconsistency between some articles and their numbering. Additionally, we proposed to take into account some comments on the legal certainty, as well as the consistency of some provisions of the law with the Constitution of Ukraine.

Most importantly, these comments do not change the essence and spirit of the reform. So we hope that the Parliament will finalize the draft law No.3014 promptly and adopt it as a whole!

Why is this law important?
  1. It will replace the obsolete Law “On Telecommunications” of 2004 and the Law “On Radio Frequency Resource of Ukraine” of 2000.
  2. It will protect the rights of subscribers.
  3. It will create a better environment for telecom business development.
  4. It will allow Ukraine to fulfil its obligations under the Association Agreement while being harmonized with the updated EU legislation.

The first text of the law based on the EU Code was drafted by BRDO experts and presented to the Office of the President on August 27, 2019. The text of the draft law was prepared for the first reading by a working group within the Verkhovna Rada’s Committee on Digital Transformation. The working group included representatives of operators, providers, associations, and experts from the Better Regulation Delivery Office (BRDO). The BRDO expert Nadiya Kostryba coordinated the working group to prepare the draft law for the first reading.
