Abolish 49% of regulatory instruments in the field of the Ministry of Health – a recommendation of the Interdepartmental Working Group on Deregulation

The interdepartmental working group on issues of accelerated review of instruments of state regulation of economic activity (IWG on deregulation) recommended canceling 49% of instruments of state regulation in the spheres of competence of the Ministry of Health and subordinate central executive bodies. Another 25% of tools (licenses, permits, approvals, etc.) are proposed to be modernised.

The corresponding decisions were made at the meeting of the IWG on deregulation, which is chaired by the First Deputy Prime Minister – Minister of Economy of Ukraine Yulia Svyrydenko and the Deputy Prime Minister – Minister of Digital Transformation Mykhailo Fedorov. The meetings are also attended by representatives of leading analytical centres, in particular BRDO.

What regulatory instruments are recommended for abolition?

  • a number of conclusions of the state sanitary-epidemiological examination for various spheres of activity (in particular, a conclusion on waste management facilities);
  • permission for the production, processing and sale of food products and food additives, hygiene and sanitation items, cosmetic and perfumery products, alcoholic beverages, tobacco products, household chemicals and children’s assortment;
  • permission to use dangerous factors;
  • approval of documentation for the development, manufacture and use of new machines, mechanisms, equipment, other means of production, new technologies, production processes;
  • approval of pre-project documentation schemes related to regional planning and development of settlements, resorts, etc.;
  • attestation-expert opinion confirming the presence of healing abilities in a person;
  • special permit for practicing folk medicine (healing);
  • permission to use essence intended for aromatization of certain types of products for other products;
  • permission to use a new supplement;
  • certificate of state registration of the disinfectant;
  • permission to open pharmacies with a deviation from the norms of minimum provision of the population by state and communal health care institutions that sell medicinal products;
  • cancellation of State Labor approval procedures in the process of determining categories of employees who are subject to medical examination in the current year, approval of lists of such employees, approval of plans-schedules for conducting medical examinations of employees of the enterprise and approval of the final act based on the results of periodic medical examinations of employees in accordance with the order on amendments to the order Ministry of Health “On approval of the Procedure for conducting medical examinations of employees of certain categories” dated 05/21/2007 No. 246;
  • a sanitary passport for permanent transportation of sources of ionizing radiation and a sanitary passport for the use of specialized vehicles that deliver products arriving on the ship. , as sanitary passports, and based on the results of their review, make proposals for improving the regulatory field.

A license to carry out economic activities for medical practice, a conclusion on the quality of the medicinal product, an annual periodical medical examination of drivers who carry out passenger and cargo transportation work, etc. are planned to be optimised.

This is the fourth meeting of the Interdepartmental Working Group. To remind, based on the results of the previous meetings, it is recommended:

  • cancel or modernise a third of state regulatory instruments from the sphere of the Ministry of Infrastructure;
  • cancel 45% of regulatory instruments from the Ministry of Environment;
  • cancel 47% of the current instruments of state regulation in the sphere of the Ministry of Economy.

Based on the results of the IWG decisions, legislative projects will be developed, which will undergo a general approval procedure by the Central Committees, including public discussions on the proposed changes.
